Digital Millennium Copyright Act Policy

Notice of Infringement – Claim

  1. A signature of the copyright owner (or an authorized representative);
  2. Identification of the copyrighted work allegedly infringed;
  3. Identification of the infringing material to be removed, and details to help locate the material;
  4. Contact information of the complaining party, including name, address, email, phone, and fax number;
  5. A statement that the complaining party believes the material is used without authorization;
  6. A statement that the information provided is accurate, and that the complaining party is authorized to act on behalf of the copyright owner.

Title 17 USC §512(f) includes civil penalties against anyone who knowingly misrepresents information in a notification of infringement under 17 USC §512(c)(3).

Counter Notification – Restoration of Material

If you receive a takedown notice due to a copyright claim, you can provide a counter notification to have the material restored. The notification must be provided in writing and contain:

  1. Your signature.
  2. A description of the removed material and its original location.
  3. A statement under penalty of perjury that the material was taken down due to mistake or misidentification.
  4. Your name, address, and consent to jurisdiction of the federal district court.
